Understanding Federal Firearms Licenses (FFLs) helps customers navigate the legal requirements for receiving the Biofire Smart Gun. Federal law requires all firearms to be transferred through licensed dealers, ensuring background checks and regulatory compliance.
FFL Overview
An FFL (Federal Firearms License) holder is a business or individual licensed by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) to legally engage in firearms-related commerce. FFLs can sell, transfer, manufacture, import, and receive firearms depending on their specific license type. Common FFL holders include gun stores, pawnshops, shooting ranges, and gunsmiths.
Types of FFLs
Several types of FFLs exist, but most customers will interact with Type 01 (Dealer in Firearms) or Type 02 (Pawnbroker) license holders. These are the businesses authorized to facilitate firearm transfers to individual purchasers.
FFL Shipping Requirements
Biofire sells directly to customers, however, U.S. Federal law prohibits firearm manufacturers and online retailers from shipping firearms directly to customers' homes. All firearms, including the Smart Gun, must be transferred through a licensed FFL.
This federal requirement serves several critical purposes:
- Background checks
Background Checks are completed before the firearm is released to the purchaser, helping prevent firearms from reaching prohibited individuals
- Federal and state regulations
Regulations are followed for every firearm purchase, ensuring compliance with varying laws across jurisdictions
- Safe, traceable transfers
Transfers are maintained through official records, creating an important accountability chain for law enforcement
This system has been in place since the Gun Control Act of 1968 and applies federally to all firearm purchases made across state lines or from manufacturers.
FFL Selection
The Biofire fulfillment team will reach out to each customer to coordinate shipping to an FFL in their local area before shipping an order. Biofire will work directly with the FFL to exchange the necessary paperwork for each order.
Biofire can help find an FFL if customers don't already have a relationship with a local dealer. Customers can also search for dealers in their area using the ATF's FFL database or online FFL search tools.
