Countdown Sweepstakes Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. AT THE TIME OF ENTRY, YOU MUST BE A LEGAL RESIDENT OF THE UNITED STATES AND LEGALLY ABLE TO PURCHASE A HANDGUN.

1. General: These Biofire Countdown Official Sweepstakes Rules ("Rules") govern the Biofire Early Access Sweepstakes ("Sweepstakes"). The Sweepstakes is sponsored by Biofire Hermes Inc. ("Biofire," "we," or "us"). Individuals participating in this Sweepstakes are referred to herein as "you" or "entrant". No purchase or referral is necessary to enter. Completing a purchase or a referral does not increase your chances of winning.

2. Eligibility: This Sweepstakes is open to anyone 21 years or older that can legally purchase a handgun in their location of residence and lives in one of the 50 states of the USA, Washington DC, and US Territories. Employees of Biofire, or our affiliates and subsidiaries (collectively the "Employees"), and immediate family members and/or those living in the same household of Employees are not eligible to participate in this Sweepstakes. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.

3. Agreement to Rules: By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements. In addition, you agree to accept all decisions of Biofire as final and binding as they relate to the Sweepstakes.

4. Entry Period: Entries will be accepted online starting on [April 9, 2023 at 12:00am] MST and ending April 12, 2023 at 11:59pm MST (the “Entry Period”). All entries must be received by Biofire prior to expiration of this Entry Period. Proof of sending or submission will not be deemed to be proof of receipt by Biofire.

5. Prize: Home defense training with a former Navy SEAL. Prize. Travel, lodging and meals to be provided by Biofire. The value of the prize will be dependent on travel but will not exceed $4,999. Travel and lodging will be arranged by Biofire and must originate within United States of America (and specifically excludes US territories and possessions).

6. Winner Selection and Notification: One (1) winner will be selected by random drawing on April 17, 2023. The winner will be notified via direct message on the social media platform through which they entered, and the winner has 5 days to respond. If a winner does not respond to our message within such 5-day period, another winner will be selected in their place. The winner will be contacted to arrange dates, travel and lodging.The winner will also be required to complete a reasonable agreement covering liability release and use of likeness. Any prize that is not legal in your state will not be shipped and you will be disqualified from the Sweepstakes. There are no substitutions of the prize.

7. Odds: The odds of winning depend on the number of eligible entries received during the Entry Period and the number of entries that you have during the applicable Entry Period.

8. How to Enter: To enter the Sweepstakes, you must both: (a) follow Biofire on Twitter, LinkedIn, Facebook or Instagram, and (b) share at least one post from Biofire on your applicable social media page using the #unlockbiofire hashtag. Please note that in order for your entry to be valid, you must be following Biofire and your share of the Biofire post must remain active on the applicable social media site as of the end of the Entry Period. Only one (1) entry will be awarded per social media handle.

Except as prohibited, all entries become the exclusive property of Biofire. Biofire is not responsible for improperly submitted entries, which will be disqualified.

9. Other Terms & Conditions: Biofire reserves the right, in its sole discretion, to cancel, terminate, modify or suspend this Sweepstakes should virus, bug, non-authorized human intervention, fraud, or other cause beyond Biofire’s control corrupt or affect the administration, security, fairness, or proper conduct of the Sweepstakes. In such case, Biofire may select the winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Biofire. Biofire reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes. Biofire has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void entries for any reason. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. Should such attempt be made, Biofire reserves the right to seek damages to the fullest extent permitted by law. Once you have won a sweepstakes you cannot win another one hosted by Biofire until six months have passed. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration regarding an account, the authorized account holder will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an account/profile by the entity that owns the applicable email address. The potential winner may be required to show proof of being the authorized account holder. Notwithstanding the foregoing, in distributing the prize, Biofire is entitled to rely on all communications sent from (or appearing to be sent from) the winning social media account even if such communications are not actually sent by the authorized account holder.

10. Limitation of Liability: By entering the Sweepstakes, you agree to release and hold harmless Biofire and its subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) your participation in the Sweepstakes and/or your acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Sweepstakes; or (v) electronic or human error in the administration of the Sweepstakes or the processing of entries.

11. Disputes: THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF COLORADO, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, you agree that any and all disputes that cannot be resolved between the parties, and any and all causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court situated in the town of Broomfield, Colorado. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney's fees, other than participant's actual out-of-pocket expenses (e.g., costs associated with entering this Sweepstakes). You further waive all rights to have damages multiplied or increased.

Any and all claims, judgments and awards shall be limited to the lesser of $5,000 or the actual out of pocket costs incurred to submit an eligible entry for this Sweepstakes (whichever is less), but in no event any attorneys' fees; and under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses as described above, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

12. Collection of Personal Information: Use of your personal information is governed by Biofire's Privacy Policy. You may at a later date opt-out of the receipt of email communications by following the directions in the email. Opt-in or opt-out status will not affect your participation or chances to win in this Sweepstakes.

13. Severability: If any provision(s) of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

14. Winner's List: For list of winners and a set of these Rules, send a self-addressed, stamped envelope to: Biofire Hermes Inc., Biofire Countdown Sweepstakes, Attention: Marketing, PO Box 408, Broomfield, CO 80038. Requests must be received within thirty (30) days of the conclusion of the Sweepstakes (or such later date as may otherwise be required by law). Residents of Vermont (and any other jurisdiction that requires the same by law) may exclude return postage for these Rules.
