Biofire Promise (Returns)

Return Period. During a period of 30 days from when you take possession of your Smart Gun (the “Return Period”), subject to the terms of this Biofire Promise Policy, you may return your Smart Gun for a full refund for any or no reason.

Products. Your Smart Gun, Dock, accessories, and all packaging included in the order you are returning must be returned at the same time (collectively the “Products”).

Process. To return your Products, contact Biofire Customer Support at [email protected] to obtain a Return Merchandise Authorization (a “Biofire RMA”). A return shipping label and instructions will be provided for shipping your Products back to Biofire. You must carefully follow all instructions provided by Biofire to ensure that your Products are not damaged during return shipping and to comply with various federal, state, and local laws. Provided that your Products are eligible for return, Biofire’s actual costs in shipping the Products to you during fulfillment and shipping your Products back to Biofire will be deducted from your refunded purchase price.

Do not return your Products without a Biofire RMA and shipping label, this may be a violation of federal law, and we will be required to refuse receipt of the package.

Exclusions. Biofire Promise returns are not applicable to the following:

1. Returns initiated after the Return Period;
2. If you fail to take possession of your Smart Gun within 30 days from the date that Biofire notifies you that your Smart Gun has been delivered to your local firearms dealer;
3. If your Smart Gun is not returned in a factory reset state;
4. Smart Gun editions that are labeled as not being eligible for returns;
5. If your Products have been misused or damaged in any way, including without limitation firing your Smart Gun with hand loaded, reloaded, or improper ammunition, firing with an obstruction in the barrel, or damage resulting from a failure to provide reasonable and necessary maintenance as described in the manual accompanying your Smart Gun;
6. If any unauthorized repair or any alteration, including of a cosmetic nature, has been performed on your Products;
7. If more than 150 rounds have been fired on your Smart Gun;
8. If there are signs of tampering with your Products or accompanying software;
9. If there are signs that any of your Products were stored in extreme conditions, such as extreme heat or cold that could damage your Products’ functionality;
10. If any of your Products are no longer in a “Like-New” condition, Products should be returned undamaged, clean, and free from any signs of use;
11. If any Products sold to you under the returned order are not returned;
12. If you are not the original purchaser the Products were sold to by Biofire or are unable to return the Products from the same state in which we delivered them; or
13. Products purchased by businesses or used for commercial purposes.

If any Product is not eligible for return, the remaining Products may be eligible for a pro-rated return if they can be resold (e.g., if you have damaged a magazine, but the Smart Gun, Dock and other components are in a “Like-New” condition, you may be refunded the price less the cost of the magazine).

Method of Refund. If you return your Products and Biofire assesses them as eligible for return under this policy, you will receive a refund in the original form of payment less appropriate deductions, provided that if a refund in the original form of payment is prohibited by applicable rules or regulations, Biofire may use a reasonable alternative to provide you with a refund.

Please allow up to 30 days after the return is received and inspected for the refund to be processed.
